General terms and conditions of sales on e-Tecsup

Article 1 : Acceptance of Terms & Conditions
The present general sales terms are available in French and concern all orders passed via the e-Tecsup service on our website www.tecsup.fr
- All orders imply that the client has agreed to all the terms and conditions.
- The terms can be subject to modifications without notice
- Only the version visible applies at the moment the order is made.
Article 2 : The Offers
The description, photos and prices of the e-Tecsup articles can be modified or deleted at any time, without notice. The photographs are for indication purposes, and not contractual.
The offers presented on our website, will be handled and prepared only once the order confirmation and payment validation have been received.
Article 3 : Price
The prices indicated are in Euros, all tax included, but not including delivery costs (see article 5). They are valid the day the client makes the order.
All change concerning V.A.T. will be automatically applied to the end price.
Article 4 : Orders
The information retrieved by the client during the order on-line, will be automatically recorded and be considered as valid proof of the nature, content and date of the order.
The information engages the client.
- All orders vie the e-Tecsup on-line service are destined for the client's personal use.
- The client or receivers of the products are prohibited to resell part or all of the products.
- Tecsup reserves the right to suspend or annul any order, notably in the case of litigious files, incidents, or nonpayment.
Article 5 : Delivery
The articles are dispatched via Colissimo (La Poste) in Europe. They will be delivered to the delivery address indicated by the client on the order form. A participation will be billed for article ordered by the client : 11 € for France - 27,5 € for Export. The articles will travel at the receivers own risk and perils. In the case of partial damage or loss, the client must take all the necessary steps and contact the transporter without delay in order to protect his rights concerning the issue.
Article 6 : Delivery Lead Times
All e-Tecsup orders are delivered within two working days (France) / 3-5 working days (Export), within the limit of stocks available, not taking account for exceptional circumstances or Force Majeure. Delivery is considered effected the moment the merchandise leaves the factory.
- In the event of no stock available, the client will be informed and will have the possibility to annul his order and be reimbursed.
- In the event where delivery is totally impossible (war, riots, fires, strikes, lock-out, accidents, disease, bad weather, product terminated,..) Tecsup reserves the right to annul the order and retract without further indemnities.
Article 7 : Payment
The price is payable in its totality, at the moment the order is made, in one payment via credit card (e-carte bleue, Carte Bleue, VISA, MasterCard, AmEx).
The transaction will be made by CYBERPLUS Payment and validated by 3D Secure.
3D secure is a secured on-line payment transaction program, conceived and put into action by VISA & MasterCard, and equally used by the Group of Bank Credit Cards.
Article 8 : Retraction
The client disposes of a 7 day period, starting from the date of delivery, to exercise his right to retract.
During this time he can send back the purchased article to Tecsup, (7, Avenue du Pré de Challes PAE des Glaisins - 74940 Annecy-Le-Vieux), against exchange or reimbursement , under the condition that the article is perfect condition, in its own original packaging, with all the accessories, documents and proof of purchase. The cost and responsibility of the return delivery are at the clients own cost, complying with article L.121-20-01 of the consumers code.
Article 9 : Warranty
The Tecsup warranty concerns all the e-Tecsup article prices. It is limited in the repartition or exchange of known defaulted products under reserve of the respect of the conditions of storage, installation, use or maintenance as indicated in the manufacturer's notice. No product can be returned without Tecsups prior agreement.
It's applied to all products from the e-Tecsup service, not including batteries, for a 2 year period, starting from the date of order. For certain articles (see article descriptions), a further guarantee can be arranged.
Article 10 : Liability
Tecsup will not be held responsible for direct or indirect damages which could happen via its on-line e-Tecsup service.
Article 11 : Jurisdiction attribution
In the case of contestation, French law is the only applicable authority at the Commerce Tribunal of Annecy, even in the case of wagering warranties by the asker or defender.
